Service terms
Terms and conditions
These terms govern subscriptions to and use of Loky, a service supplied by WARE SRL.
1. Supplier and contact details
The service is supplied by WARE SRL, Via Provinciale 82, Albino (BG), Italy, VAT No. 04876650161, email info@dmware.it, referred to below as “WARE”.
2. The Loky service
Loky is a web application for organising and storing credentials, notes and attachments in an encrypted vault. The subscription includes a dedicated environment, a personal address on the loky.app domain, maintenance and ordinary updates. The Personal plan includes 500 MB for encrypted attachments; the Professional plan includes 2 GB, priority support and professional use. The limit for each file is 10 MB. Passwords and credentials do not count towards the attachment quota. Android and iOS apps are being designed and are not part of the features currently included.
3. Individual and business customers
Loky may be purchased by consumers, professionals and businesses. At checkout, the Customer identifies their status and provides accurate personal and tax information. A person purchasing for purposes outside their trade or profession benefits from the mandatory protections applicable to consumers.
4. Activation and requirements
After payment is confirmed, WARE checks the requested address and normally prepares the vault within 2 working days. If the chosen name is unavailable or non-compliant, WARE contacts the Customer to agree a different one. The Customer must keep their email address accessible and have the legal capacity required to enter into the contract.
5. Master password and Customer responsibilities
The Customer chooses the master password and safeguards any recovery codes. WARE cannot recover the master password: losing it may make the content inaccessible. The Customer is responsible for the data entered, the lawfulness of its processing, the security of their devices and the prompt revocation of access that is no longer authorised.
6. Permitted use
The service may not be used for illegal activities, to compromise systems or third-party rights, distribute malware, attempt unauthorised access or upload content prohibited by law. WARE may temporarily suspend the service where reasonably necessary for security, legal obligations or serious breaches, informing the Customer where permitted.
7. Prices, taxes and payments
The selected price and billing period are shown before confirmation on Stripe. Unless otherwise stated, consumer prices include VAT; final taxes and billing details are summarised at checkout based on the information provided. Payments are processed by Stripe and the Customer authorises recurring charges under the selected plan. WARE does not store complete card data.
8. Term, renewal and cancellation
The subscription is monthly or annual and renews automatically for periods of the same length until cancelled. Cancellation prevents the next renewal and does not interrupt access before the end of the already paid period. Subject to mandatory rights, an ongoing period is not refunded solely because the service was not used.
9. Consumer right of withdrawal
A Customer who is a consumer may exercise the right of withdrawal within 14 days after entering into the contract by emailing info@dmware.it and stating their name, order email and intention to withdraw. If the Customer requests vault activation before the withdrawal period ends, a proportionate amount for the service supplied before notice of withdrawal may be due. All mandatory consumer protections remain unaffected.
10. Availability, maintenance and support
WARE takes reasonable measures for continuity and security but does not guarantee the complete absence of interruptions. Maintenance, urgent updates, network failures or events outside WARE’s reasonable control may occur. Standard support is available through info@dmware.it; additional professional work may be quoted separately.
11. Retention and termination
At the end of the subscription, the vault is deactivated. Data may be retained for a technical period of no more than 30 days to allow management and recovery and then deleted, unless the law or a different agreement requires otherwise. Before expiry, the Customer should arrange a copy of any information they need.
12. Liability
WARE is liable under applicable law for damage directly attributable to its breach. It is not liable for consequences arising from a lost master password, compromised devices, unauthorised use of Customer credentials, inaccurate data or unlawful conduct by the Customer. No provision limits liability or rights that cannot legally be excluded.
13. Intellectual property
The software, interface, trademarks, text and service components remain the property of their respective owners. The subscription grants a personal, limited and non-transferable right to use Loky for the term of the contract. The Customer retains rights in their own content.
14. Privacy and data processing
Processing of data relating to the website, purchase and account is described in the Privacy Notice. For personal data uploaded by a business Customer to the vault, the parties may define their respective roles through a data processing agreement.
15. Changes to the service and terms
WARE may update features and terms for technical, security, legal or organisational reasons. Material changes applying to an existing subscription will be notified with reasonable notice; where required by law, the Customer may withdraw.
16. Governing law and jurisdiction
The contract is governed by Italian law. Consumers retain the jurisdiction required by mandatory law, normally that of their place of residence or domicile. In all other cases, the courts of Bergamo, Italy, have jurisdiction unless otherwise agreed in writing.
